Justice Rahel Barkai of the Israeli Be'er Shiva District Court sentenced a rejected an appeal by the Israeli prosecution to sentence a settler to seven years for shooting a Palestinian resident and decided to sentence him only to two consecutive years and one year on parole.
The settler Daniel Finner, 39, a resident of the West Bank settlement of Tapuah, shot and wounded a Palestinian resident of Al Mawassi area in the Gaza Strip, in June 2005.
According to the charges, Finner burst onto the scene with a loaded Uzi submachine gun and began firing in the air and directly at the Palestinians.
One Palestinian man was severely wounded by the gunfire and was rushed to a hospital to be operated upon.
The attack was carried out three months before Israel implemented the Disengagement Plan.
The settler was among an extremist settlers group that attacked Palestinian families staying near the Gaza Beach.
Israeli online daily Haaretz reported that Finner was at a hotel occupied by the settlers at the Gaza beach. He was carrying out maintenance work on the hotel's electricity system.
The assailant told the court that he cannot understand why is the court making a “big deal out of shooting a Palestinian resident”.
The Israeli prosecution demanded the court to sentence the resident to seven years imprisonment and to compensate the injured resident, but the court rejected the appeal.
Justice Barkai did not rule the the Finner should be disarmed but decided to bar him from carrying his gun outside the borders of his settlement, Tapuah.
She also said in her ruling that the assailant “did not think that wounding a Palestinian was of any importance, and returned calmly to the hotel after the event. Later, he returned to his home in Tapuah, completely confident that he would not be punished for his actions", yet he received a mild sentence.

Soldiers deliberately killed the three youth in Rafah
A probe conducted by the Israeli army revealed that the soldiers, who killed the three Palestinian youth in Rafah April 9, did not aim their weapons at the lower parts of the body as the army claimed originally.
The findings of the probe revealed that the incident was a “shoot to kill“ case against the three youth.
The probe which was conducted by the Southern Command of the Israeli army revealed that apparently the youth were attempting to damage a surveillance camera installed by the army in that area, “in preparation for a smuggling operation in the future"?, according to initial findings.
After the three youth were killed, army claimed that they crawling in a closed military zone in an attempt to reach the Egyptian side to smuggle arms.
“Soldiers from the Golani Brigade, spotted five youth moving towards the border, after an armored personnel carrier left the area, three of them broke into the security zone and ran towards the Egyptian borders, army fired warning shots, and they started to retreat, but three of them tried to infiltrate another time and where spotted by an officer and two soldiers who fired more than 12 rounds at them from a close range, killing them instantly?, the probe revealed.
“Israeli army rules of engagement along the Philadelphi route in Rafah did not change, as a result of the need to prevent arms smuggling in that area, soldiers acted in accordance to their responsibilities, but there was no reason for this incident to end in the death of the three youth, soldiers acted as if they were confronting an armed cell"?, an Israeli military source said after the Southern Command announced its findings.
The probe is expected to continue over the coming days, so far no measures were taken against the officer and soldiers involved in the fatal incident.

Palestinian driver Iyad Dwek 30, who was shot dead by soldiers after presumably running over Eyal, had no ties to any Palestinian resistance group, and no weapons were found in his car.
Very likely, Eyal was killed by a fellow soldier, and Dwek was unnecessarily killed following what appears to be a car accident.

Israeli military murders school children at anti-Wall protest
of Beit Liqya, near Jerusalem, killed, with his cousin, by IDF gunfire to his heart during a demonstration against the annexation wall.
Two cousins, 14 and 15 years old, were shot dead today by Israeli soldiers who opened fire on a demonstration against the Apartheid Wall in the village of Beit Liqya.
After school ended for the day students went out to protest against the illegal Wall which is right now cutting through their homes and lands threatening the livelihood and freedom of movement of the entire region. Israeli soldiers, positioned on a hill above the demonstration, met the student’s confrontation with live fire. According to eye witnesses, the two boys were shot by the same soldier from a distance of 5 to 10 meters.
Jamal Jaber Ibrahim Assi, 15, received a bullet in the heart and died at the scene. Odai Mufid Mahmoud Assi, 14, was shot in the left side of his stomach. The two boys, who were cousins, were rushed by ambulance to the village of Biddu while doctors tried in vain to save Obai. He died enroute to the hospital. Their bodies are currently in the Ramallah Government Hospital.
Less than 5km away in the neighboring village of Bil’in, residents organized a non violent action against the annexation wall. Sixteen people, nine Palestinians, joined by Israelis and internationals chained themselves to the olive trees while fifty others demonstrated. Bil’in farmers had received notice yesterday that eighty five olive trees would be uprooted to make way for the illegal Wall and called for International and Israeli support. After a stand off that lasted four hours, the Israeli military using excessive force cut the chains and dragged away twelve of the non- violent protesters, arresting 6 Internationals and 5 Israelis.
The six Internationals arrested are scheduled to have deportation hearings at Ben Gurion airport at 8:30 AM Thursday morning 5 May after which they may be immediately deported from the country. They are Atle from Norway, Maria from Greece, Yohan from Sweden, Nathan and Gabe from the United States, and Ester.
Please call the Ministry of the Interior to protest their deportation and point out that the building of the Wall was ruled illegal by the International Court of Justice in the Hague which ordered that it be dismantled. This ruling has been ignored by the Israeli government which continues to build the Wall each day destroying more homes and trees as it steals more Palestinian land.
All the Palestinians who were initially detained were all released. All 5 arrested Israelis were released after agreeing not to return to Bil’in for 15 days.

New B’Tselem Report: Take No Prisoners
Today, B'Tselem is publishing Take No Prisoner: Lethal Shooting of Palestinians by Israeli Forces During Arrest Operations. Based on testimonies of Palestinians and IDF soldiers given to B'Tselem over the past year, the report raises the strong suspicion that during this time the military engaged in assassinations in the guise of arrest operations. There is no indication that security forces were instructed to kill the Palestinians defined as '?wanted.'? However, the information B'Tselem collected indicate that, in some of these cases, the soldiers acted as if they were carrying out assassinations, and made no real attempt to apprehend the Palestinians.
According to B'Tselem's figures, in 2004, Israeli security forces killed 89 Palestinians during actions defined as arrest operations. At least 17 of the people killed were not '?wanted,'? but were civilians whom Israel suspected of no wrongdoing. At least 43 of those who were defined as '?wanted'? were not involved in fighting at the time they were killed. To the best of B'Tselem's knowledge, not one Military Police investigation has been opened regarding these killings.
In two of the cases described in the report, soldiers besieged a house in which Israel claimed that a wanted man was present, and shot another man as soon as he opened the door. In two other cases, the security forces shot and killed men they defined as wanted, after soldiers had already neutralized any threat the men might pose.
According to B'Tselem, responsibility for the creation of norms in which the security forces carry out executions rests with the highest echelon of the Israeli defense establishment. With the outbreak of the second intifada, the IDF changed the rules of engagement, in general, and the regulations for arresting suspects, in particular. In recent years, the IDF has ordered soldiers to use lethal force in cases in which soldiers' lives are not in danger; has failed to clearly explain the rules of engagement to soldiers, and has not opened Military Police investigations following the killing of Palestinian civilians by IDF gunfire, except in exceptional cases.
