Jerusalem Rabbinical Court wants woman jailed for refusing to accept divorce

Wife refuses divorce because of financial dispute threatened with prison sentence if won’t agree to divorce, in unusual rabbinical court case.
In a rare move, the Jerusalem Rabbinical Court ordered a 59-year-old woman jailed this week for refusing for 15 years to accept a ritual divorce from her husband and release him from their marriage.
Disputes over refusals to grant a get, or Jewish religious separation, are common, but usually involve a husband holding back the bill of divorce, making this a rare case.
The woman, who lives in the center of the country, is refusing to accept the divorce from her husband because of an ongoing property dispute between the two.
“I won’t take the get under any circumstances, even if they take me to jail,” the woman told Haaretz Monday. “I’m made of steel, you can’t break me.”
The rabbinical court took the step after imposing a series of sanctions on her, in an effort to force her to accept the divorce. But after these efforts failed, the court, comprising rabbis Avraham Sheinfeld, Eliyahu Abergil and Mordechai Toledano, ordered her imprisoned for 30 days.
While under Jewish law the power to divorce rests with the husband, a man cannot divorce his wife against her will. This leaves the wife some leverage, as she must accept the divorce for it to be valid.
The couple married in 1987, three months before their only child, a boy, was born. It was the second marriage for both. In 1996, the husband filed for divorce with the local rabbinate and at the end of that year the rabbinical court ordered her to accept a divorce, but she refused.
The woman conditioned her acceptance of the divorce on her getting a home they owned in the center of the country and $1.5 million. The woman claimed that by this she was abandoning her claim to other, substantial property her husband owned, including a profitable business.
The husband claimed that she had gotten her share of their property under the receivership law, and that she was blackmailing him by withholding the divorce, which keeps him from being able to remarry by Jewish law.
To force her to accept the divorce, the rabbinical court blocked her from leaving the country, restricted her bank account and suspended her driver’s license. But the woman remained firm.
In 2001 the rabbinical court even granted the husband permission to marry again, another relative rarity. But his attorney, Shmuel Gross, noted that the Interior Ministry will not “unlink” the woman from her husband without a ritual divorce, and that as far as it’s concerned, the two are still married.
Attorney Irit Rosenblum, who heads the New Family organization, has appealed to the ministry on the husband’s behalf, asking it to change the man’s status from “married” to “under clarification.”
She noted that whatever the status of their personal relationship, having the woman listed as his wife has ramifications relating to pension rights and inheritance, the Tax Authority, the National Insurance Institute and the health funds.
Batia Kahana-Dror, who heads the organization Mevoi Satum, which helps and advocates for women being denied a divorce, said she had never heard of a woman being jailed for refusing to accept a get. Nevertheless, she backed the court’s action.
“A get should not be a blackmailing tool for a man or a woman,” she said.

Update 7:40 pm CDT – Asher Dahan may be the same Asher Dahan who was convicted of raping two girls, one 16-years-old and the other 17-years-old, in 2006. He was sentenced to four years in prison, a lighter than normal sentence that took into account his age (59 then) and his lack of a criminal record. …Police arrested a suspect following the stabbing. People close to the rabbi said the suspect frequently visited Abuhatzeira to receive blessings and advice. Witnesses said the suspect entered the room with a knife and stabbed him numerous times in his chest.
"The rabbi was a righteous person. This is a great loss," said City Council Member Yaakov Ohayon. "We are shocked. The Jewish people have lost one of their supporting pillars. The rabbi was murdered while he was giving advice and guidance to people in need of his help. He has thousands of Hassidic followers and he is one of the greatest rabbis in the world," he added.…

Beersheba - Rabbi Abuchatzeira's Suspected Murderer Indicted
Beersheba - Despite a psychiatrist opinion deeming him unfit to stand trial, Asher Dahan, who is suspected of killing Rabbi Elazar Abuchatzeira, was indicted for murder on Tuesday.
Two weeks after the Northern District’s chief psychiatrist declared Dahan unfit for trial, the Southern District Prosecutor filed an indictment with the Beersheba District Court.
According to the indictment, Dahan was among Rabbi Abuchatzeira’s followers for many years, and occasionally sought his advice on different matters. When Dahan wanted to divorce his wife because he suspected she was cheating on him, the rabbi advised him to stay in his marriage. Dahan apparently did not appreciate the advice.
It is suspected that Dahan thought Abuchatzeira’s advice was motivated by greed, and decided to kill him. He hid a knife in his tefillin and went to the rabbi’s office, where he stabbed him in the chest.

Britain bans radical Israeli rabbi
TEL AVIV, Israel (Ma'an) -- The British border agency has informed a fundamentalist Rabbi that he will not be allowed to enter the country for the next three years, Israeli daily Haaretz reported Thursday.
Rabbi Yosef Elitzur received a letter from the British authorities, signed by the home secretary, informing him of their decision.
Elitzur is co-author of the hard-line book "The King's Torah" and was briefly arrested in Israel last August on suspicion of incitement to violence.
Riots took place in Israel in July 2011 after police arrested a Rabbi who had endorsed the controversial book. Over 1,000 supporters of Yaakov Yosef, son of one of Israel's top religious leaders, took to streets after reports of his arrest.
The book, which has been banned from sale in Israel, reportedly says babies and children of Israel's enemies may be killed in certain circumstances since "it is clear that they will grow to harm us."
It also says non-Jews are "uncompassionate by nature" and that attacks on them "curb their evil inclination."
"Anywhere where the influence of gentiles constitutes a threat to the life of Israel, it is permissible to kill them," the authors wrote.

Chabad rabbi abducted in Ecuador; released unharmed
Rabbi Tomer Rotem falls prey to ruthless kidnapping after being lured to meeting with mysterious 'donor,' released after five days.
Cleared for publication: Rabbi Tomer Rotem, Chabad's envoy to Quito, Ecuador, was abducted and held hostage for five days in the South American capital. He was eventually released, unharmed.
News of the abduction was placed under a gag order, which was lifted on Thursday.
Rabbi Rotem told Ynet that back in July, he had received a call from a man who introduced himself as the "head of an Israeli yeshiva," and told him that one of his students was a former Ecuadorian now living in Israel.
The student, Rotem was told, was the acquaintance of a wealthy elderly Jew who was on his deathbed, and "wanted to donate all his worldly possessions in favor of Chabad's good work."
According to the caller, the Chabad House in Quito was in line for a one million dollar donation from the man's estate," Rotem said.
The caller asked about the work done at the Chabad House in Quito and Rotem confided in him that the donation money would enable him to buy the building.
"After that conversation, he would call several times a week," the rabbi said. "He asked me to send his lawyer a detailed plan of how we would use the donation money, and said he would have his son make sure the money was delivered to us. I was just grateful for the godsend."
International man of mystery
Rabbi Rotem told Ynet that he attempted to find out more information about the caller, but to no avail.
"I tried Googling the rabbi who called me, but didn’t find anything. I didn’t find that suspicious, though. He said he was an elderly man who didn’t know much about the internet."
What little trepidation Rotem felt was put at ease when a local attorney contacted him as promised, to coach him ahead of his meeting with the "benefactor."
"She told me to meet her in Manta (in Manabí Province) and that I would leave for the meeting from there. She definitely sounded like a legalist."
Rotem's confidence grew when a plane ticket waited for him at the local airport – as promised. Little did he imagine the flight he was about to embark on would be land him in the midst of a fight for his life.
Held at gunpoint
Rotem said he was met at the Manta Airport by a man who told him that the meeting's location had been changed to Puerto Lopez, which is where many people buy vacation homes.
After a two-hour ride, the car stopped. "The next thing I know, two masked men are pointing machine guns at me," Rotem said. He recognized a third man standing nearby as someone he had helped in the past, and had a falling out with.
He was bound and gagged and subjected to a series of violent interrogations: "They kept asking me how much money I have, and beating me. They threatened me with a knife, threatened to make me eat pork."
Rotem said he was subjected to hours of brutal integration. His abductors threatened his family as well, and also threatened to bury him alive.
"I kept pleading with him – we considered him family once. But he wouldn’t listen."
In the course of the first night, Rabbi Rotem was forced to record a ransom tape. For the next for days, he said, he kept pleading with them, trying to reason with them and "using Jewish reasoning, even though none of the three guards were Jewish. I told them – no one leaves this world with out being held accountable for his actions.
"It was hard, but eventually I could see that they were opening up to what I said," he told Ynet.
Rotem's abductors moved him several times in an attempt to cover their tracks – keeping him bound and blindfolded at all times.
The ransom demand was sent to his wife, Rivkah, who had the local police and the Israel Police Latin America Liaison by her side, when it arrived.
"She was coached every step of the way and we're grateful for the Israeli police's assistance," he said.
All well that ends well
During the five-day ordeal, the local police were camped in and around the Rotems' home in Quito.
After five days, Rotem said, his abductors changed their demands, asking the ransom cover only the "abduction costs," which amounted to $10,000. Rotem was released shortly thereafter, after promising he will pay the money himself as soon as he got home.
"This is a miracle. It's unprecedented that a man is abducted and released unharmed without paying a penny in ransom," he told Ynet.
Under police supervision, the rabbi met with his abductor to pay the ransom. He taped the meeting, which led to the Israeli perpetrator's arrest.
The man faced a lengthy indictment, which includes multiple counts of abduction, extortion and hate crimes. The suspect has a criminal record which includes international drag trafficking.
With the horrid ordeal behind him Rabbi Rotem still finds it hard to believe: "Abductions are rare here. They really only happen to the super-wealthy, which we are not. We helped him before – I guess he was after the Chabad House money."
Following the abduction, the security around the Chabad House in Quito has been substantially increased.
"We have guards 24/7 now. We remain open to all and all Israelis and Jews are welcome here," he stressed. "Donations would be welcome. We just want to keep doing good work."

PA condemns conference hosted by hard-line Rabbi

BETHLEHEM (Ma'an) -- The Palestinian Authority condemned the Israeli government on Wednesday for allowing a conference hosted by a hard-line Rabbi to take place Tuesday in the Pisgat Zeev settlement in East Jerusalem.
"The Israeli authorities’ ongoing and consistent tolerance towards hate speech and incitement against Palestinians leads to actions," director of the PA's media center Ghassan Khatib said Wednesday.
The conference was hosted by Rabbi Yitzshak Shapiro, a co-author of the notoriously racist "King's Torah", and called for halting construction of a Palestinian school in between Pisgat Zeev and Nabi Taakov settlements in East Jerusalem, as well as preventing Jewish girls from dating Arab men.
In addition, the conference demanded that the Jerusalem light railway project should be banned from passing through Palestinian neighborhoods, a PA statement said.
"In the name of freedom of speech, settlers are given freedom of incitement and freedom to use violence against Palestinians," Khatib added.
The Palestinian Government Media Center "calls upon the Israeli authorities and the government to take serious actions to prevent continuing settler incitement and violations.
"We, also, call upon the international community to hold the Israeli government accountable for permitting incitement and violence of settlers to go unpunished."

NJ rabbi accused of sexual abuse
Rabbi Uzi Rivlin indicted on suspicion of molesting two 13-year-old Israeli boys during their summer trip to US.
WASHINGTON – Rabbi Uzi Rivlin, from Teaneck, New Jersey, was arrested this week on suspicion of sexually assaulting two 13-year-old boys visiting from Israel.
An indictment against Rivlin was filed Wednesday with the New Jersey High Court. He pleaded not guilty.
Rivlin, 63, hosted the two boys on separate occasions in 2009 and 2010 in his house while they were visiting the United States as part of a scholarship program for low-income Israeli families, founded by the rabbi.
Upon their return to Israel the two teens filed a police complaint, claiming that Rivlin sexually abused them during their stay at his house. The Israel Police transferred the details of the complaint to US police authorities, which launched an investigation in cooperation with the FBI and the Bergen County prosecution.
According to Jewish Telegraphic Agency JTA, the Rabbi is held in custody and was unable to post the $175,000 bail set by the court. Rivlin was also asked to hand in his Israeli passport to the court.
Attorney Howard Simmons, representing Rivlin, said to a local newspaper that the rabbi is confused and disappointed by the charges, adding that he does not understand why the boys made such accusations against him.
Rabbi Rivlin is the founder of Scholarship Fund for the Advancement of Children in Israel, in which children from low income families exchange letters with American children from Rivlin's the religious school classes at the Temple B'nai Abraham in Tarrytown, N.Y., some 25 miles north of Manhattan.

Is The Talmud Defensible As A Holy Text?
Question: Has the time come for people of conscience to acquaint themselves with the Jewish Talmud?

After all that has happened, is it time for everyone to start buying Talmud compendia and distributing them to friends and family?—with certain passages marked and highlighted? Maybe a little stocking-stuffer this Christmas?
Maybe slip one in the mailbox of your favorite Christian zionist? Or send copies to soldiers in Afghanistan and Iraq, so they can see what they’re fighting for? It could certainly liven up some dull evenings.
Maybe those guys who remotely operate killer drones from a safe location would be interested in learning something new—to give them a little perspective on what they are doing, and for whom.
You could put up a sign in your yard, automobile, or business, displaying a Talmud Quote of the Week. Think of it as a public service announcement—and keep spare copies of your compendium to show to critics who complain. Maybe when they see that those words really are in the Talmud—it’s not just something perverted you made up—they will experience a sudden paradigm shift. An aha-moment, if you will.
Certain Christian evangelicals love to rail against the Koran, a book they’ve never read, as the source of all evil in the world. I suspect some of them are unaware of the content of their own Old Testament, which celebrates the slaughter, rape and pillage of other peoples.
But their greatest ignorance of all concerns Judaism’s holy books—not the Torah but the Talmud, which is a series of interpretations of early Judaic law, written by later rabbinical scholars. Think of it as an exhaustive collection of technicalities allowing one to get around the law—with the notable addition of directives to persecute non-Jews, who are not considered human—and to do so as a religious duty. Surprisingly, the content of the Talmud has not rendered it obsolete or embarrassing to modern orthodox Jews who study it, revere it, and live by it. It’s the kind of thing that never gets mentioned at Holocaust Museums, the History Channel, or in Hollywood films like Exodus. Nothing about it in The Fiddler On The Roof either. So I thought I’d mention it here, for folks who don’t know. When an ethnic group has a religious duty to persecute everybody else, that’s a pretty big deal.
In certain European countries holocaust-denial is a criminal offense, based on the notion that it promotes racism and genocide. Shouldn’t Talmudism be a crime in those countries, and for the same reason? Doesn’t the assertion that all the world’s non-Jews are animals unworthy of compassion meet the criterion?
What are we to do about venerable holy texts that contain evil things? Do we just give them a pass?
Jews suffered political setbacks, throughout the centuries, whenever Gentiles discovered what was in the Talmud. Later versions, created for Gentile readers, were “cleaned up” so as to soften and obscure the offending parts; but the original texts are still used without apology by true believers.
This is an issue for modern Jews finally to confront squarely, and choose their allegiances: Is the Talmud defensible as a holy text? And can Jews ever be accepted by the world so long as they fail to renounce it and make apology?- I believe the answer is no. Israel Shahak and others argue, convincingly, that its genocidal doctrine inspires covert evil, ultimately endangering the non-Talmudic Jews of the world by association—not to mention endangering the rest of us as well.
So perhaps a little sunlight is needed to bring this out into the open?

That campaign just received a boost from an unexpected source, as one of religious Zionism's most influential rabbis joined the call against the practice of kaparot, in which an individual's transgressions are ceremonially transferred to an animal or inanimate object.
Shlomo Aviner, head of Jerusalem's Ateret Yeshiva and rabbi of the settlement of Beit El, has spoken out in the past against the contentious rite. This time, however, he acceded to the SPCA's request and issued a religious ruling that, rather than slaughtering an animal, giving money to the poor is a better method of absolving oneself of transgressions.
"Because this is not a binding obligation but a custom, in light of problems related to kashrut and the suffering of animals, and given the edicts of the aforementioned rabbis, a recommendation must be made to favor performing kaparot through money, by performing the great mitzvah of providing for the needy," Aviner wrote, citing religious decrees by rabbinical authorities from various periods throughout Jewish history.

Dozens of rabbis have confirmed their participation in an emergency meeting scheduled to be held Monday in the unauthorized settlement of Migron in the Binyamin region, following the demolition of three houses last week and ahead of the planned razing of dozens of other structures.
Tzohar Chairman Rabbi David Stav confirmed that the organization's president, Rabbi Yaakov Ariel, will represent Tzohar at the meeting. "We are taking part in the effort to organize a meeting with the prime minister on this issue," Stav told Ynet.
Hundreds of rabbis have been invited to the rally, which will be attended by representatives of different Religious Zionism streams, including senior members of the Tzohar organization, which usually avoids engaging in political issues.
'Religious Zionism united thanks to Bibi'

Apart from Rabbi Ariel, speeches will also be delivered by Rabbis Haim Drukman, Dov Lior, Zalman Baruch Melamed and Nahum Eliezer Rabinovich – all senior Religious Zionism leaders, as well as Migron Rabbi Itai Halevi and Mateh Binyamin Council head Avi Roeh.
The rabbis will later hold an open discussion along with other religious leaders on ways to save the Migron houses. Rabbi Shmuel Eliyahu will conduct a children's prayer.
The rally was initiated by two rabbinical organizations" Derech Emunah and the Teaching House for Public Affairs. The first body brings together hundreds of right-wing rabbis and is identified as the National Union's rabbis' council.
The organization was headed in the past by Chief Rabbis Avraham Shapira and Mordechai Eliyahu, who were considered the leaders of Religious Zionism. The organization's activity weakened following Rabbi Shapira's death, but has been resumed in the past two years.
Harel Cohen, the organization's secretary-general and one of the meeting's organizers, told Ynet that the Prime Minister Benjamin Netanyahu would have to be thanked for the event's success.
"Bibi is an expert in betraying the trust of his Israel-loving voters, uniting Religious Zionism and its rabbis," he said.
The meeting's organizers say the issues on the agenda have not been determined yet, but that they are convinced that refusing orders during the evacuation of Jewish communities will be a major topic.
According to the organizers, last week was the first time since the State's establishment that settlers' permanent houses were destroyed in the middle of the night.

Israel's international isolation and the hatred of Jews worldwide are the punishment for the demolition of three houses in the Migron outpost two weeks ago, Kiryat Arba Rabbi Dov Lior ruled Monday during a conference held at the Binyamin region community.
"We all saw that on the day the buildings were destroyed the diplomats were expelled from Turkey, and the Egyptians were next and later the Jordanians," the prominent right-wing rabbi stated. "The waves of anti-Semitism in Europe are a punishment for this as well."
According to Lior, every time Israel tries to "please the villain," its status in the world suffers.
He went on to slam the Israeli Left. "There are circles of villains seeking to give away parts of this land to our enemies. Luckily, God Almighty causes the camel riders to refuse to meet with the government…
"There are leftists fighting the people of Israel's return to their land… They have put the public to sleep with opium of peace… The Hollywood culture and singing in discotheques will not do good, but bad."
The rabbi referred to the Arabs as "wolves", adding: "What we have with those villains and savages is not peace, and it won't be peace. It's against their nature. They hate peace."
He called Israel should be cleared of Arabs, who should be given a right of return to places like Saudi Arabia. "The Land of Israel belongs to the people of Israel only," he ruled.
Migron, Lior said, is not an occupied area, neither according to international law nor according to the Torah. If it is indeed an occupied area, he argued, then so is the village of Sheikh Munis (where northern Tel Aviv is located).
According to Rabbi Lior, the people of Israel benefit from the recent events in the Middle East because "everything happens for a reason." He noted that thanks to "the hooligans' riots in Libya, Egypt and Yemen" and the West's involvement in places like Iraq, Israel can "move a tank" in Judea and Samaria.
'Deeply shocked' by destruction
Some 20 Religious Zionism rabbis, some of them prominent, took part in the Migron conference, which was held by two rabbinical organizations – Derech Emunah and the Teaching House for Public Affairs.
Rabbi Haim Drukman cried out against the "rules of Sodom" and the injustice in removing families from their homes in the middle of the night because of a "property error".
Rabbi Zalman Melamed called on the religious public to join forces – first among the rabbis and then among the public and its representatives in the Knesset – in order to thwart the further destruction of communities and continue their construction.
At the end of the rally, the rabbis issued a "public call" to annex Judea and Samaria to the State of Israel and apply the Israeli law to the area.
The participants expressed their "deep shock" over the demolition of houses in Migron, claiming that the residents were not given a real chance to prove the legitimacy of the construction to the Supreme Court.
They also called on the justice minister to prosecute anyone "who in his eagerness to destroy, deviated from the appropriate procedures in a normal country."

Rabbi Dov Lior: Collective punishment against rioters
Friday terror attack leaving father, son dead. Hilltop Youth leaders pledge to stop further stone hurling in area; Rabbi Dov Lior: No innocents in war.
Clashes between settlers and Palestinians broke out Sunday following a rally commemorating the deaths of Asher Palmer and his infant son Yehonatan in Kiryat Arba last Friday.
Some 150 people held a protest rally in the scene of the terror attack prior to the victims' funeral. They marched towards Kiryat Arba and clashes broke out near the Beit Anoun village. The two sides began hurling stones at each other. IDF and police forces arrived at the scene to end the violence using crowd dispersal means.
During the rally, Rabbi Dov Lior called for a collective punishment to be carried out against the "rioters."
"We have murderous rioters surrounding us, according to the Torah, there is room for collective punishment and the IDF must carry out the punishment against the rioters. There are no innocents in a war," the rabbi said.
The city's Jewish spokesman Noam Arnon added: "I say this with a great deal of pain and sadness – there was an attempt to hide the truth. We know the effort put in here by the security forces and we cherish that, but we must say that this repulsive attempt to hide the truth was not the only one, this unthinkable thing was done without any clear motives."
Police initially claimed the car crash which killed the father and son was the result of an accident but later concluded that stones had been hurled at the vehicle, which caused it to overturn. Settler leaders leveled harsh criticism at the police for what they referred to as a "cover up."
Asher Palmer's brother Shmuel addressed the failure of the police to declare the incident a terror attack from the beginning. "The police are a problematic organization as is the IDF. And I say this as a reservist," he said. He added that he could understand talk of revenge. "A Jew was murdered here because he was a Jew, and this cannot be ignored. We shall prevail at the end, the only question is how. We are here to stay."
Meir Bartler, one of the Hilltop Youth leaders, said that his men will not stay silent. "The hurling of stones must be stopped. If the IDF can't do it, then we'll do it and we know how. We shall deploy our men along the line. Anyone with a licensed weapon will arrive and we'll equip others with batons and protective gear."
The police said in response: "The initial investigation indicated the incident was the result of a self-inflicted car accident causing the car to crash into a pile of rocks. Evidence found inside the vehicle led the police to perform an external autopsy at the State and the family's approval.
"The autopsy indicated that the driver was hit in the head by a blunt object which led us to believe that a rock may have been hurled at the car. The family was informed of the progress in the case. The investigation is still ongoing and the family will be provided with all the findings when it concludes. "
IDF: No cover up
The IDF Spokesperson's Office rejected claims that it did not tell the truth about the terror attack, and tried to cover it up as an accident.
"The IDF is completely rejecting the claims. As the investigation developed, the police presented new findings related to the circumstances of the incident," the statement said.
The IDF expressed regret over the death of the father and son, and stressed that the preliminary investigation that it concluded on Friday was based on evidence collected by police investigators who arrived at the scene of the car crash.
"A Central Command check held Friday indicated no stones were hurled at the car from the side of the road. Further findings then suggested the possibility that stones had been hurled from a passing vehicle. The issue is being checked," it said.
