Leila Musa Aer, 35, sitting with one of her surviving daughters, Malak, 2
“I have four girls who are alive. I have two boys and another girl who are dead. I don’t feel as though they are dead. I still talk to them. I tell them everything I used to tell them before. I still buy them clothes. They aren’t dead. They’re just away. They are going to come back,” says Leila before her stepson, Nahedh, gently led her out of the room before coming back to explain, “Leila has become very unstable.
She has sort of lost her mind. I think it’s because they bulldozed her children in front of her. She went hysterical at that point. She used to have a strong personality. I think that if there hadn’t been Israeli bulldozers, she would have been able to survive this.”
Trying to Flee
At 5.15pm on 3 January 2009 as the Israeli ground offensive began, an artillery shell hit the Al Err family’s barn; the explosion shook the entire house.
As the family tried to flee on a donkey-drawn cart, another shell struck, landing in the middle of the cart. In April 2009, Nahedh explained what happened to Al Mezan, “I looked at the donkey cart and saw that it was turned upside down, its wheels in the air and the donkey dead.
I looked at my wife Iman and saw her face covered in blood and her eyes wide open. I saw my sister Fida’ on the ground about four metres away with her face and back covered in blood. I could not see Ibrahim, Rakan and my father (Mohammed).”
Those who could, escaped to a neighbour’s house (Mohammed Al ‘Atawni), where they called for an ambulance. Ibrahim was already dead; his body dismembered. Iman, Fida’ and Nahedh were injured. Mohammed and Rakan couldn’t be found.
At around 6.00pm, when the ambulance still hadn’t arrived, Nahedh decided to go for help, hopping on one leg. He came across an ambulance and begged the medics to rescue his family but they were unable to and instead took him to Al Awda hospital for treatment.
Trapped in Jabalia
Fida’ died from her injures the same day. Iman was bleeding profusely and died the next day at around 1.30pm.
Unable to escape because of the shelling and shooting, the Al Err and Al ‘Atawni families remained trapped with the dead bodies for five days.
On 8 January, Israeli forces started to bulldoze the Al Err and Al ‘Atawni houses with the survivors still inside.
Nahedh found out what happened when he later reunited with his family, “The Israelis ordered them to leave the house. My stepmother was crying and screaming, saying ‘We have dead bodies! There are bodies in there!’
They ignored her. The bulldozers destroyed the house over the dead bodies. They bulldozed her children in front of her.”
Life will never be the same
A year later, Leila is still undergoing psychological treatment. Nahedh explains, “I think she’s a bit better than she was. When we first used to go to the cemetery, she kept trying to dig up the earth around the graves with her hands.
Even now we have to stay with her all the time; 24 hours a day. Medicines Sans Frontiers (MSF) are following her condition. When we told them we were moving to a fourth floor apartment they advised us not to. They think she might throw herself out of the window.
They still come to us every week. Leila needs medication to sleep and when she wakes up in the night she tries to find her children. Whenever she remembers what happened, it’s as though it happened yesterday. We’ve been told not to let her talk about it.”
Nahedh’s life now revolves around caring for his stepmother. He used to be a shepherd and is struggling to adapt to urban life. “Sixty of my goats were killed and two donkeys. We are a Bedouin family and we used to go to the city only once every few months.
We lost our only source of income when they killed the goats. I feel strangled in this house but it’s not safe to go back to Jabalia. My life has completely changed. We’re just trying to survive now.”

Three siblings killed when trying to flee shelling
On 3 January 2009, an Israeli shell struck the donkey cart of the al-Err family in Jabalia town while they were preparing to evacuate their home.
Two brothers, Ibrahim (11) and Rakan (4), along with their father, were instantly killed; their sister Feda’ (17) and sister-in-law Iman (26) died of their injuries as ambulances were prevented from reaching them.
Israeli bulldozers started demolishing the house with survivors inside;
the families managed to flee but soldiers prevented them from evacuating the bodies of their relatives and demolished both houses over the bodies of the dead.
On the evening of Saturday, 3 January, one week after the start of Operation Cast Lead and hours before the beginning of the ground offensive, the al-Err family were at home, in the Eastern side of Jabalia town, north Gaza, about 500 metres from the border with Israel.
Inside the house was
Mohammad al-Err (46), his wife
Leila (38), his son
Nahedh (25) and wife
Iman (26), and
Mohammad’s seven other children:
Neda’ (19),
Feda’ (17),
Sana’ (15),
Yasmin (13),
Ibrahim (11),
Rakan (4) and
Malak (2); as well as their cousin
Ahed (14).
At around 5:15pm an explosion shook the entire house and was followed by the sound of shrapnel.
Nahedh, the eldest son, went to check the farm yard where the family kept goats and where the shrapnel seemed to have hit. A donkey and several goats had been killed by shrapnel.
The father, Mohammad al-Err, decided to evacuate the area and go to a relative’s house in Jabalia camp, which he thought safer than their home close to the border.
The family also feared the start of the ground invasion; they could already see and hear Israeli tanks stationed at the border to the East. Mohammad asked Nahedh to help him prepare the donkey cart.
Nahedh’s wife Iman, his sister Feda’ and brothers Ibrahim and Rakan were sitting on the cart. Other family members were still inside the house preparing themselves for the evacuation.
Nahedh recalls: “Suddenly, a huge explosion took place and I felt myself flying into the air and falling hard against the ground. Shrapnel hit me all over the body... I felt that I would die at any moment. Then I heard my father saying “Oh” but I could not see him.
I did not know where the shell had thrown him, although I knew he was the closest one to me; just one metre away. I looked at the donkey cart and saw that it was turned upside down, its wheels in the air and the donkey dead.
I looked at my wife Iman and saw her face covered in blood and her eyes wide open.
I saw my sister Feda’ on the ground, about four metres away, with her face and back covered in blood. I could not see Ibrahim, Rakan and my father. My stepmother, Leila, and sisters were shouting loudly inside the house.”
Nahedh could not go back home because the cart was in the way. He was also afraid that another shell would be launched. He was injured in the foot. He crawled towards his neighbour’s house, 70 metres away.
People from the al-Atawni family got out of the house to help Nahedh when they saw him. Nahedh asked Mohammad al-Atawni to call an ambulance to rescue his family. The ambulance service
Nahedh and stepmother Leila, after the incident, Ma’an
responded positively. Nahedh went into the al-Atawni house followed by his stepmother Leila and his sisters Sana’ and Neda’ who were carrying the dismembered body of their brother Ibrahim.
Leila, Sana’ and Neda’ went back to get Feda’ and Iman who were injured. Feda’ had injuries all over her body. Iman was injured in the face and leg.
Mohammad al-Atawni and some al-Err family members tried in vain to recover the bodies of Rakan and his father, Mohammad al-Err.
It was dark and the electricity was cut off; Israeli tanks stationed at the border started shooting towards them and they were all terrified. Mohammad al-Atawni called the ambulance again and was informed that the army had refused to coordinate their access to the area.
Consequently, Nahedh decided to go look for an ambulance himself. He left the al-Atawni house and hopped on his injured leg for 1,200 metres.
A neighbour lent him a horse cart and he went to al-Jarn area, in Jabalia town.
There, Nahedh saw an ambulance and begged the paramedic to go and retrieve his family but the paramedic informed him that there was nothing he could do without coordination with the Israelis. Nahedh was taken to al-Awdah hospital where he received treatment.
Meanwhile Mohammad al-Atawni was trying to give first aid treatment to Nahedh’s wife Iman who was losing a lot of blood; and Nahedh’s sister Feda’ lost consciousness 20 minutes after being injured.
Mohammad al-Atawni assumed her dead and put her and Ibrahim in a separate room.
The al-Atawni and al-Err families remained in the al-Atawni house because they were afraid that they would be attacked if they tried to leave. They were still hoping an ambulance would come and evacuate them. They spent the night in a terrified state, besieged by Israeli tanks firing towards the house.
At around 1:30pm the next day, Iman eventually died of her injuries and severe blood loss.
Both families were trapped with their dead for five days, besieged by Israeli tanks and terrified by tank fire and the sounds of bulldozers and explosions all around them.
Mohammad al-Atawni recalls: “Abu Nahedh’s family, my family and I remained inside the house for five consecutive days. We were terrified. There were explosions everywhere.
Tanks and Israeli bulldozers were moving around the entire area.
Electricity was cut off as well. Abu Nahedh’s children and wife were in a very bad situation. They were traumatized. They refused to eat or talk.”
On the fifth day, an Israeli bulldozer started destroying the house in which they were. Mohammad told DCI-Palestine: “Once I got out I saw three Israeli bulldozers.
Two of them were demolishing our house, while the third one was demolishing Abu Nahedh’s house. I saw many Israeli soldiers with their faces painted different colours. They were pointing their assault rifles at us.
“We have dead and injured persons and children with us,” I started shouting loudly. One of the soldiers… said to me in broken Arabic:
“Don’t talk to me about dead and injured persons, all of you head West.” He wanted us to go west to Gaza City
and Jabalia. We left the dead persons inside the house and walked away.
I was about 20 metres away from my house when I saw the bulldozer demolish my 200 square metre house, with a metal panel roof. I saw the house being levelled to the ground. I also saw Abu Nahedh’s house being reduced to rubble.
We walked two kilometres on our way to al-Jarn circle, amid continuous shooting. I think snipers were shooting at us, not tanks because all the bullets were fired above our heads to intimidate us.”
Nahedh spent three days in hospital without knowing anything about his family’s fate. After being discharged from hospital on 6 January, he went to a relative’s house in Jabalia camp.
Two days later, he was joined by the rest of his family.
They informed him that his wife Iman, and his siblings Ibrahim and Feda’ had died, but they did not know what had happened to their father and their brother Rakan.
Nahedh was also told that the al-Atawni home has been demolished over the bodies of his wife and siblings.
After the Israeli withdrawal from north Gaza on 18 January, two weeks after the attack, Nahedh went back home. He found his house reduced to rubble, and people searching under the rubble of the al-Atawni house to retrieve dead bodies.
Rescuers managed to retrieve the bodies of Iman, Feda’ and Ibrahim and found Rakan’s body near the site of the explosion.
All the bodies were decomposing. Mohammad al-Err’s body could only be recovered on 21 January, three days after the withdrawal of Israeli troops, under the rubble of his own home.
Total number of people killed as a result of the attack:
Rakan (4)
Ibrahim (10)
Feda’ (17)
Iman (26)
Mohammad (46)
The remaining members of the al-Err family now live with their paternal uncle, Abu Khaled, in Jabalia camp.
On 18 April 2009. Nahedh told DCI-Palestine: “I go to the eastern border everyday to graze what is left of our goats, and I stay near our demolished house, remembering my father, siblings and wife.”
DCI-Palestine was unable to gather information from other family members because of their very fragile emotional and psychological state.

Sujud Hamdi Juma al-Dardasawi, 14Ahmed As`ad Tubayl , 15
Sujudof al-Shejaya, near Gaza City, Gaza, killed by the IDF in al-Shejaya.
Name of the Victim: Ahmed As`ad Tubayl: Details of the Last Hours:As usual, Ahmad Tubayl went to "Ibrahim Al-Makadmah's mosque" to perform the Maghrib prayer on the third of January. After performing Salah, an Israeli reconnaissance warplane hit the people who were coming out of the mosque, causing Ahmad to fall as a martyr and left dozens of citizens in causalities.
Other Information:
Ahmed was fantastic. He amazes you when you see tens of certificates of appreciation that he obtained in many fields. In the Islamic Sciences, Ahmad was not only satisfied to memorize the Qur'an in five ways of recitations, memorizing 1500 Hadith, and the study of the rules of recitation, but he studied also the science of distributing inheritance according to the Islamic Shariah.
As in the field of technical sciences, he was not only, as his father called him, a junior electronic engineer but also the first to use several modern technical programs in Gaza Strip.
Ahmed was a first-grade student in Ahmad Ash-Shuqiry's Secondary School and he always got the highest degrees. As in the final year of secondary school, which he could not reach, everyone knew him expected that he would be ranked the first in the scientific field in Gaza.
His father said: "The Professor used to entrust him with the questions of the tests to print, and when I told the professor not to do so, he would say: "Those were not difficult questions for Ahmed."
The professor also used to entrust him with the degrees of all students in the school. He was very honest; may Allah bestow mercy on his soul."
About his qualities his mother said: "Ahmed had interest in religious sciences as well as the worldly sciences. He was kind and tolerant. Two days before his martyrdom, he found me sad for people fell martyrs, he said to me: "O mother, do not cry or weep when I get martyred because a martyr only feels a pinch of a needle when killed." May Allah accept him in the Gardens of Eternity."
Ahmed was characterized with intimate family relationships. He was so much attached with his sister "Rola" and she was the deposit of his secrets. He was the closest to his father as `Aziz `Ali Ahmad said: "I was dreaming of the day on which he will become an engineer or someone important in the society. I remember how he was wearing my clothes and I loved him doing that because we were friends.
He was skilled at fixing computers and used to fix all the family equipments. He died and did not fix the equipment of his brother Rafiq. Ahmed was a junior electronic engineer, a calligrapher, an artist, a story writer."
His father says about his commitment to the mosque: "I woke up early to find him offering prayer at 3 AM., then get ready to go to the mosque. A friend of mine, who used to go to the mosque early, told me that his wish was to precede Ahmed to the mosque, but he could not.
"Today, after Ahmed's death, he can do that." Father sadly said.

Hassan Nassim 'Amer Hiju, 15Sherif `Abdul-Mu`ty Sulayman Armilat, 15
Name of Victim: Hasan Nisim Hijju : Details of Last Hours:
Hasan did not acquiesce to the war that Gaza was suffering. Soon he went out with his friends, moving from an alley to another without caring for the state of terror that was imposed on north Gaza in particular.
After his mother had succeeded to obtain some bread, Hasan ate his breakfast, changed his clothes, and went out to play "Al-Bananir" game with the boys of his neighborhood. When it was the time for Al-Maghrib prayer, his brother took him to offer the prayer in Ibrahim Al-Maqadmah's mosque. After they had finished, intended to go home, a reconnaissance warplane aimed at the people coming out of the mosque causing tens of casualties.
The sixteen-years-old boy Hasan Hijju was one of those little kids who were shot in the head. Hasan was killed inside the most beloved mosque to his heart where he dedicated a place to memorize the Glorious Qur'an.
More Information:
Hasan loved and cared for the young kids so much, especially the kids of his neighborhood to the extent that Hamzah, the neighbors' kid, comes to ask about him until today. Days before he had been martyred, Hasan asked his mother to beget a child for him and when she told him that she had enough kids, he asked her dearly to beget a little one for his sake.
His mother said: "I begot two boys and seven girls and I was dreaming of a day to come in which I could see the boys grow up to become young men." They had killed Hasan, while he was offering prayer, before I could see him a young man.
I remember when he asked me to let him marry with his brother in the same day, but I refused and said: we shall let you marry in a different day so that we can celebrate more and more. Allah is sufficient for us, and how fine a trustee He is! Now, I have nothing to do but to supplicate Allah for my little baby. I ask Him to be pleased with Hasan and admit him to the highest place in Paradise — by Allah's Will."
His Dreams:
His mother said: "Hasan was not so much brilliant at school but he was so in memorizing the Qur'an. He used to memorize the Qur'an easily with his brother then hurry to the mosque to tell what he had memorized. His first wish was to become a sheikh and an instructor to teach the Islamic subjects and the Qur'an to young children, but unfortunately, he died before he could make that dream come true.

Sherif Place of Death: At his home near Karm Abu Salem's Passageway, Rafah City — the South of Gaza Strip. Cause of Death: An Israeli Tank shell.
Details of the last hours:
On the third of January, the family gathered in the home yard among the olive trees, while Sherif walked steadily to the door of the house watching outside. He heard the sounds of the shells went high from time to time, so he wanted to see what is going on; perhaps he can help an injured or a wounded. He stood at the door and lent his back against the wall, few seconds have passed but an Israeli tank aimed a shell at him. The shrapnel penetrated his head and back, left him on the ground soaked in blood.
His mother did not see him off because she was possessed by a severe state of depression that left her unable to speak out of sorrow. She announced mourning by wearing in black. Sherif was her mum's supporter, helper, and the soft heart that treated her kindly. He promised her mother to bear the responsibility of improving their living standards when growing up. Her mother waited for that day but it did not and would not come because the one who took the promise left and the promised mother remained in a state of sorrow with a heart full of pain.
Sherif was the beloved one to his sister Maryem to whom he told all his worries, pains, and sorrows. Maryem said after she had fallen into moments of silence during which she recalled the memory of her brother: "He was so close to my heart. I miss him so much." She was the first to see him lying on the ground dead.
After the bombard, a man brought his body and placed him in front of his house so that his mother could have the last look before he was buried. In a time when the family ran away of the bombard and destruction, the shrapnel split his head and broke his back.
His Dreams:
Despite his young age, Sherif was a responsible man, who used to help his father in sustaining his siblings and so kind to his sisters and mother; he used to kiss her hand all the time.
Sherif wished to grow up to relieve his father from the responsibility of providing sustenance to his siblings and to bear it after he would finish his education and get a suitable job, but nothing of his wishes came true because his life span was over before he realized his dreams.

as-Selawy Family:
“What affected us a lot psychologically is the fact that we were all praying in the mosque when we were attacked. The mosque is a place where we go when we need relief or when we are sad. We could never imagine them targeting us while we are praying in the mosque.”
On 3 January 2009, at around 17:20, during prayer time, an Israeli drone fired a missile at the western entrance of al-Maqadma mosque in Jabaliya refugee camp.In the attack, 15 worshipers were killed and hundreds were injured.
“In every prayer I remember what happened in the mosque that day. I remember where I saw dismembered arms, legs and other body parts lying on the floor. I can still see our relatives and friends scattered around the praying room”, says sheikh Motee’ as-Selawy (forty-nine) as he puts his head in his hands. He was standing on the sheikh’s podium delivering a speech to the worshipers as the missile hit the entrance. “I had a direct line of sight to the door of the mosque and I saw pieces of red shrapnel flying towards us through the doorway,” he recalls.
The extended as-Selawy family, who live together in one big house opposite the mosque, lost five of its members, all of whom were praying in the mosque when it was attacked: Ahmad Isma’il (22), Mohammed Mousa Isma’il (twelve), Ibrahim Mousa Aissa (forty-four), Hani Mohammed (eight), and ‘Omar Abdel Hafez as-Selawy (twenty-seven).
Motee’s brother, Ismai’l Mousa as-Selawy (fifty-three), lost his oldest son, Ahmad Isma’il, in the attack. “I cry every day for my son. I have been suffering a lot over the past three years. He was everything for our family. I visit the grave of my son once or twice a week at least. I remember him in every moment, whether I am at home, in the mosque or somewhere else”, says Isma’il.
“We miss our killed relatives on all occasions. Our family lives in the same building and we used to have a lot of fun together. Now we visit their graves”, adds Motee’.
Six members of the as-Selawy family were injured in the attack and several of them continue to physically suffer from shrapnel that remains embedded in their bodies. “I still have shrapnel in my right wrist and it gives me problems until now. Doctors in Gaza said a surgery to remove the shrapnel might to do more harm than good. I feel constant tingling and my right hand is weak. I can’t carry anything with it,” says Motee’. Another relative, Mohammed Khalil es-Selawy (fourteen), has shrapnel embedded in his head, which caused him to lose his hearing requiring him to wear hearing aids. Brothers Abdel Karim Mohammad as-Selawy (twelve) and Maher Mohammed as-Selawy (thirt) also have to learn how to live with shrapnel embedded in their bodies; Abdel Karim has fragments in his shoulder while Maher has pieces in his liver. Tamer Khalil (twenty-two) and Mousa Isma’il (twenty-three) as-Selawy were also injured by shrapnel in their backs but doctors were able to remove the metal parts from their bodies.
“What affected us a lot psychologically is the fact that we were all praying in the mosque when we were attacked. The mosque is a place where we go when we need relief or when we are sad. We could never imagine them targeting us while we are praying in the mosque. That is a big crime,” says Motee’. The grandfather of the family, Mousa ‘Issa Mohammad es-Selawy (93), adds; “the mosque is the house of god. There are no soldiers or weapons in the house. Everyone comes to pray there and enjoy being there. How could they target it like that?”
Motee’ recalls, “Goldstone came to visit us in our house and went to the mosque with us to investigate. I asked him; ‘where do you go when you feel sad and tired?’ He said, ‘I go to a place for prayer.’ I asked him, ‘what if you were bombed there?’ Goldstone said; ‘I cannot imagine it. Such a crime should be punished.’ Now Goldstone has apologized for his report and we have not seen any results on the ground.”
Since the attack the as-Selawy is not only mourning the loss of its relatives. The family members are also struggling financially as three of their deceased relatives used to provide for a vital part of the family income. Ibrahim left behind 9 daughters, who still live at home. “Who will take care of them now?” asks Motee’. ‘Omar Abdel Hafez had 4 daughters and one son. Until the day of his death he earned the family income working as a cameraman with a local TV channel. Ismai’il’s son, Ahmad, was the father of two children, Mohammed (five) and Nisreen (three and a half), and used to work as a tailor.
“My concerns now are mainly focused on my grandchildren, Mohammed and Nisreen, and how I can bring them up. I want to give them a future but I am too sick too work. My health was badly affected by the attack and the loss of my son”, says Isma’il, who suffers from severe migraine and stomach problems. “I try to take care of them as much as possible, but I will not be here forever.”
The as-Selawy’s try to deal with the financial difficulties by themselves as much as possible. “We have our dignity but we are forced sometimes to receive aid from people because we need to live” says Motee’. “Besides prosecution of the perpetrators, we need financial compensation to deal with our current situation.”
The family has little expectations regarding the outcome of legal proceedings within the Israeli legal system. “The Israelis are prolonging the court proceedings and we don’t see any positive results. We may have hopes if our case is taken to an international court,” says Motee’.
3 jan 2012 PCHR submitted a criminal complaint to the Israeli authorities on behalf of the as-Selawy family on 2 July 2009. To-date, no response has been received.

The house was occupied and desecrated by Israeli soldiers, as was the house of Muhammad and Matar. Some of the graffiti penned by Israeli soldiers included: “Your underwear is good,” which the family had tried to scrub off.
In Matar’s house significant shelling and shooting ripped into walls and windows. Much more graffiti in Hebrew stained the walls. A sketch of a nude woman.

Wadi'a Amin 'Omar 'Omar, 2Mahmoud Sami Yihya 'Asaliyah, 3
Name of Victim: Wadi‘a Ameen ‘Umar: Details of the last hours:
Thinking that his house was pretty far away from the range of brutal Israeli artillery, Ameen, ‘Umar’s father, went outdoors in the early morning to sit on his chair listening to the news from his small radio. The first minutes passed safely and his wife joined him after finishing the housework. Three-year old Wadi‘, followed his mother’s steps towards the front door. As soon as the mother opened the door, fragments of shells scattered in her face and in her baby’s small . He was hit by Israeli shrapnel and was killed right away. The wounded mother hit the ground and turned around trying to find her baby. She saw her beloved baby lying in a four-meter-liter of his innocent blood. With her eyes full of tears, the poor mother narrated: “He did not scream, he did not say a word. It was a matter of seconds, and my baby was gone”
Young Wadi‘ passed away but his memory is still alive within the hearts of his mother, grandmother, and father. He spent his last minutes with his mother in the kitchen. While the mother was cooking, he kept interrupting her saying “Mom”. Being too busy, she did not answer him but young ‘Umar did not give up and grabbed her dress saying: “Mom, why do not you answer me? Answer me Mom”. Young ‘Umar had a great deal of self-respect; he would not tolerate talking to someone who neglects him or does not listen to his sweet baby-talk words.
Wadi‘ loved satellite channels; especially Toyor Al-Jannah. He memorized its songs especially the “Daddy … You have a phone call”, and “My well-guarded daughter”. Wadi‘ used to call upon his siblings saying: "Huda, well-guarded Huda … O Beautiful Huda”.
Wadi‘ was the apple of his mother’s eye; and for over two and a half years, he had enjoyed her undivided love and care, few months ago his younger sister, Nesmah, was born to share his mother’s love and care to him, but he was not o.k. with that . He used to feel jealous of his younger sister when he saw her in the arms of his parents, but Alas, he has gone forever.
