Ghaida was killed along with her parents and two brothers when an Israeli missile struck her home.
Saber Abu Eisha, 49, the children’s uncle, said: "Ghaida was in the second grade at school. She was like any little girl, she was pretty, she loved to play. Sometimes she was laughing, sometimes she was crying. She liked to dress up, wearing a bride’s dress, showing off."

Uncle Rashad narrates how Sayyid (12 years) was killed. A warning missile was launched on the upper floor of Abu `Aysha' family. No one could hear the missile because the inhabitants of the upper floors had evacuated and settled on the ground floor (in underground rooms). They sought refuge against the shrapnel of the aimless missiles when they fall on the security services near their home.
`Amir, his children, and his wife as well as his brethren resorted to the ground floor, thinking that the ground floor is secure and no shrapnel can reach it. No longer had it been so but the jet fighters had targeted the house of Abu `Ayshas in particularly. A U39 Missile fell on the building, penetrated the roof and the floors of the three floors then exploded in the ground floor, precisely in the room where `Amir, his children: Muhammad, Sayyid, and Ghayda', and his wife and they all died.
No one was left from the family except Dalal, Who narrates the story of death and the aftermath of the missile explosion. Nothing stayed as it was; only dust, ash, and columns of smoke that go high when a cold winter aura blows.
Dalal's memories with As-Sayyid were different, he was one-year younger but he was her soul mate. In the morning, she goes with him to school and returns back with him too. He was in the first secondary grade and used to study hard to make the dream of his father, joining a college, come true.
His Dreams:
His dreams were simple and no more than the rights guaranteed by the international laws, agreements and conventions. He dreamt of completing his studies like any other kid. He also dreamt of waking up secure without fear, horror. He dreamt the sounds of bombing and bullets would vanish one day.
However, according to the occupation, the dreams of the Gazan children seem to be impossible.

Victims of the Israeli occupation forces in the tenth day of their attacks on Gaza Strip
On January 5, 2009 three families were massacred: Samuni, Abu Eisha, and Al-Hilou .

Seven members of the Abu Eisha family were torn to pieces by shelling, said medical officials at Ash-Shifa Hospital in Gaza City. According to the medics the parents and their five children were killed when Israeli warships shelled their home in the Al-Mashtal area in the north of Ash-Shati Refugee Camp, on the shore west of Gaza City.

Medical officials at Ash-Shifa hospital also confirmed on Monday morning the deaths of seven people, including four children all members of the Samuni family in the Zaytoun neighborhood of Gaza City.
Family members who managed escape the shelling claimed more than seven people may have been killed. Jalal Samuni said told Ma'an's reporters at Ash-Shifa Hospital that more than 20 people were left inside the house which was bombarded, and he fears that many of them were killed.
He explained that the neighbors gathered in the house of Arafat Samuni who came to the area yesterday. He said that advancing Israeli troops told residents to stay in their homes. Then Israeli forces shelled the house, he said.
Earlier also in the Zaytoun area killed a five-year-old girl and her grandfather, members of the Al-Hilou family. The girl’s mother was critically injured. All the victims were evacuated to Ash-Shifa Hospital (Ma'an news)

In Continued Denial of Access to Justice, the Israeli Central Court Dismisses a Claim Filed on Behalf of the al-Daya Family
The Palestinian Centre for Human Rights said in a press release that in further evidence of the Israeli judiciary's complicity with impunity, and a continued denial of access for Palestinian victims to justice, the Israeli Central Court in Nazareth issued a decision on 05 September 2012 dismissing a claim filed on behalf of the al-Daya family, who lost 22 family members during the Israeli offensive on the Gaza Strip known as "Operation Cast Lead."
The court claimed that the victims were killed in the course of a military operation and Israel is not responsible for their deaths.
The Palestinian Centre for Human Rights (PCHR), in its capacity as the legal representative for the only surviving member of the family, was informed of the decision on 10 September 2012.
Israeli newspapers quoted the Israeli judge: "The casualty was not intended. In all wars, there are mistakes that may lead to deaths on both sides.
In wars, each party is fully responsible for the damage incurred to its members or to civilians, but not the damage incurred to the other party."
In the context of "Operation Cast Lead," the Israeli Occupation Forces (IOF) bombarded a house belonging to Fayez Misbah al-Daya in al-Zaytoun neighborhood in the east of Gaza City. The three-story house was destroyed, and 22 out of its 23 inhabitants were killed.
PCHR has followed the case of al-Daya family since 23 January 2009. On 11 February 2009, PCHR submitted a civil complaint to the Compensation Officer of the Israeli Ministry of Defense. On 18 May 2009, PCHR submitted a criminal complaint to the Israeli Military Prosecutor. PCHR did not receive any response to these complaints, so it filed a claim before the Israeli courts on 19 August 2010.
It should be noted that, in July 2009, the IOF admitted that "false intelligence led Israeli fighter jets to bombard the house of the al-Daya family, which left 22 of its members dead."[1]
It is not sufficient to simply accept the reasoning of this Israeli judge, who admitted that a mistake had occurred while, at the same time, exempting Israel from responsibility by claiming that the victims were killed in the context of a military operation; these victims were civilians, who are protected under the Fourth Geneva Convention.
Israel's recognition of their mistake indicates that the IOF did not take the necessary precautions during the attack required by international standards, including confirming that targets are not civilian objects or persons. The criminal nature of the attack, which resulted in the death of 22 members of a family, including 13 children, and 6 bodies that have never been recovered, is unchallengeable.
This new decision by the Israeli courts further evidences the Israeli judiciary's complicity with crimes committed by the IOF. It also further confirms PCHR's conclusion, gained through practical experience in the Israeli courts, that the Israeli judiciary systematically covers up crimes committed by the IOF to prevent accountability.
Moreover, this emphasizes PCHR's fight for universal jurisdiction, as a step towards achieving justice for Palestinian's who are clearly denied access to effective remedy in the Israeli courts.
PCHR will appeal this decision and exhaust all possible legal means to ensure justice, especially as the court based its decision on the 8th amendment to the Tort Law – State's Liability, which was adopted in July 2012, and which defines an act of war.
In his decision, the Israeli judge quoted articles regarding when the above amendment entered into force, but ultimately applying a new definition of an act of war to the subject of this claim even though there is an explicit provision that the amendment will not be applied retroactively, which means that its application to the case of the al-Daya family is illegal.

Every evening Baraa was pushed to leave his grandfather house and the family gathering there which he loved so much as it was time for him to go to bed upstairs. Baraa’s father tried to convince him that he had to sleep because the Israeli military has been deployed everywhere; his dad promised him to come back again to his grandfather’s gathering in the morning. Being Obedient Baraa surrendered to his father’s desire. After playing a little with his sister, Salsabeel, Baraa fell in a deep sleep.
On the morning of 6th Jan. the Israeli F16 planes shot the houses of Baraa, his grandfather and all his uncles in Al Zaitoun district, crumbling them all. The four floors, twenty three residents of Al Daia family, most of them were women and children, were killed. No one of those who were in the house but uncle Amer had survived.
Uncle Reda who was not in the house at that time remembers how little Baraa’ loved everybody and rushed to sit with whoever his grandmother brought food to. Reda says “… he was the life and soul of the family and more than all my nephews, Baraa’ stayed most of the time at the family house.”
Morover,, aunt Om-Jihad remembers the family gathering and how she enjoyed watching Baraa’ when he felt jealous of his sister, Salsabeel; Sometimes he played with her and at other times he beat her. She says “he was lovable and tactful child who was loved by everyone. No one got into our house without having Baraa pla with him after awhile.”
Baraa’a father is a mechanic who wished his son would be well-educated so as to fulfill his dream and achieve a high social position. Aunt Jihad adds “Baraa’ was so much loved by his father who wished him to be excellent at school and memorize many parts of The Noble Quran”

On 27th of December, 2008, the two-and-a-half-year old Yousef has complied to the Israeli orders to stay at home. He did not play with his bike in the street after it had been the dearest thing to his heart.
On 6th of January, Yousef lost his precious life when an Israeli air jet launched an F16 missile, targeting his home. Yousef and his family that was consisting of his parents, three siblings, grandpa, grandma, paternal aunts and uncles with their wives and children. Yousef’s little body was buried under a heap of rubble which was one day his beloved home.
Yousef’s father still remembers his dear boy who insisted to get down to the street to play with his bike at six am. His father said:”It was so early but he insisted on going out to play with his bike. I gave up and agreed. He rushed to call upon his cousin Sharaf but I did not let him wake up his uncle at that time. So, he insisted on going out to play with his bike alone as he usually did. He really loved playing with his bike. He would give his sister, Amany, a hard time in carrying his bike up and down the stairs, but who could say no to our family’s blue-eyed boy.
Young Yousef loved listening to the pulse of the fetus that was inside his mother’s womb. His mother was so happy with her coming baby and intended to call him Firas. Yousef shared his mother’s love and anticipation for the new baby or for “Bobo" as he called him. His mother used to encourage him to love his younger brother dearly and not to feel jealous of him.
Yousef’s father anxiously waited for his young child to grow up so that he would be able to walk by his side on the street full of pride of his beloved son. He said:” His hair was so pretty and I did not want to have his hair cut. Everybody loved the way it looked. His mother wished that her little angel to grow up fast and go to school so as to be as good as his sisters and cousins in memorizing the Holy Qur'an. She also hoped that one day Yousef would be a teacher. But now he has gone. The Israelis have taken our baby away as along with our dreams and hopes.” Yousef’s uncle, Rida, said:” Yousef was the apple of his grandfather’s eye; he accompanied him everywhere. His grandfather used to buy him chips and candy and would take him everywhere he goes… He also won the heart of his grandmother as well. He was extremely a beautiful and a bright kid.”

Ala' Iyad Al-Dayah: Details of Last Hours:
The six-years-old Ala' responded to her father's command to stay at home. She tried to proceed with her daily life retinue normally during the directed war against Gaza, but the F-16 warplanes targeted her house, causing her to fall from the third floor to the ground floor under the rubble. The warplanes deprived her of sleep as well as of escaping with her father and siblings!
Ala' excelled in the first grade of primary school; her mother hoped that she will join school as the rest of her siblings to reach a remarkable academic rank as she planned for all of them. In that year, she got the highest marks to please her mother.
Ala' joined a center for memorizing the Noble Qur'an and memorized one part of it. Uncle Rida remembered how did Ala' resort to her grandmother's bosom in the last time she saw her and how did she wait her grandmother to finish cooking "Al-Farashih" (local meal); as she fed up eatting canned food with the family as she always used to do during the time of war.
Her uncle said about her: "Ala' was the most beautiful girl of Iyad's daughters because she was of brushed-yellow hair and of white skin."
He added: "Ala' suffered a lot in her young age because she had difficulty in speech."
Her uncle's wife said about her: She was so soft and I felt so sad for losing her."
Her uncle Rida said about her:" I used to tease her and say to her "dumb" to make her angry, but she would start talking to prove otherwise. She was not much talkative, and when you speak to her, she will answer you, but when you do not speak to her, she keeps silent."
Her uncle added: "I loved to see her wearing Hijab and holding the hand of her mother to go to the mosque. They were a perfect religious family and God honored them by making them die as martyrs; they deserve that great status."
Her aunt Shirin said: "Their mother was so keen to give useful children to the society. Ala' was very quite and good. She loved that I visit them to play with my daughters."
Ala' used to gather her cousins to go to school. She was the first to wear her uniform and go up to call everybody then gather them to school. She was the first one to offer lunch to her friends in the alley or on the house roof.
Her cousin said: "We used to play together, eat together, and go up to the roof to play with one another. We used to love each other."

“The bodies of nine of those killed were not found, including the bodies of my wife and my children. I tried my best with the civil defense personnel to find their bodies. All we found were pieces of flesh that were unidentifiable.”
On 6 January 2009, at approximately 05:45, an Israeli aircraft bombed the al-Dayah family in the Zeitoun neighborhood of Gaza City. Twenty-two people, including twelve children and a pregnant woman, were killed. Only one of the family members inside the house at the time of the attack, Amer al-Dayah (31), survived. Amer, two brothers who had not yet returned home from Morning Prayer at a nearby mosque, and two sisters who live elsewhere with their husbands and children are the only surviving members of the al-Dayah family.
Mohammed al-Dayah (31) recalls the day of the attack: “after I finished praying, I stood beside the mosque, talking to our neighbor, waiting for the sound of the airplanes and bombardments in the area to decrease. Then I heard a very powerful explosion. Shrapnel landed where I was standing. I immediately rushed home. When I reached it, I only found a pile of rubble. I began screaming and calling out for members of my family, but there was no reply. They were all under the rubble. Dead.”

Tazal was 8 months pregnant with a boy when she was killed.
“At the moment I cannot imagine ever being happy again, or celebrating a happy occasion. It reminds me of the old life I used to have with my family. Before, I used to go to many parties. I always danced dabke, together with my extended family in Zeitoun. I led the dancing. Whenever we had a chance to celebrate, we would. Now I cannot bear the sound of party music, of celebrations. It makes me too sad. Whenever there is a party in the neighborhood, I have to leave the house and go somewhere else,” says Mohammed. The holidays are the most difficult time of the year for him: “during Ramadan and the Eid holidays I suffer and think of them even more than usual.”
His brother ‘Amer pushed Mohammed to remarry. “At first I didn’t want to but I was alone and I had to somehow rebuild a life,” says Mohammed. Now Mohammed is remarried and has two daughters, Amani (4 months) and Qamar (1,5 years old), both named after his daughters who died in the attack. “I didn’t make a party when I remarried. Neither did my brothers for their weddings. We simply do not feel like celebrating anything.”
Mohammed works as an electrician with the Ministry of Health, but has had difficulties at his work since he lost his family. “I am not able to sleep at night. The night time is the most difficult part of the day for me as I cannot fall asleep. I have tried everything. Even medicine, but that only made me dizzy. So, at night I just stay up and keep myself busy; eating, taking a walk, sitting in the cemetery, going for a run. Only after sunrise I fall asleep for a few hours, exhausted. Then, how can I go to work in time? I can’t. My boss has given me 10 warnings so far but at the same time I know that he understands and has sympathy for my situation.”
The three brothers rebuilt a house on the same place as the old building. All three of them insisted to return to the same location. “It is where we grew up,” says Mohammed. “The Ministry of Works assisted us in constructing the base and first floor of the house, but the bomb left a seven meter deep hole under the building which affected the foundation and ground water. It took us 3 months to fix the water problem, before we could even start construction of a new building.” However, Mohammed still notices that there are problems with the foundation of the building. “Every time there is a bombing, I feel the house move. It wasn’t like that before. The house is not steady. The base was destroyed by the bomb.”
As Mohammed tries to rebuild a life and a future, he has no hopes that he will see those responsible for the death of his family being held accountable. “I expect nothing from Israeli Courts. They [Israel] prepare a plan and justification first and then carry out their attack. The war crimes are justified before being committed. Crimes could happen anytime again.”
6 jan 2012 PCHR submitted a criminal complaint to the Israeli authorities on behalf of the al-Dayah family on 18 May 2009. To-date, no response has been received.

It was Tuesday, Jan. 6, at 6:00 AM, when a F16 Israeli warplanes targeted Ali's house, killing men, women, and children; 23 of them were killed, one person was survived.
Among a group of painful photographs of "Al-Daya's" massacre, the image of taking out the body of the ten-years-old `Ali from the steel and the cement was the most difficult scenes recorded in the war against Gaza. On that day, `Ali as well as 12 kids who were under ten-years-old from his family were dragged from the ruins of the house which the F16 missile turned into rubble.
`Ali was a four-primary-grade student and used to memorize six parts of the Glorious Qur'an. His 23 uncle Rida said about him: "He was popular at school by his teachers and instructors who taught him the Qur'an in the mosque because he was so special in both."
Uncle Rida remembered the results of `Ali's certificates whose one of the marks was excellent. The uncle was happy when one of the teachers was able to record a video clip of `Ali while singing in his honoring celebration after he had lost all his properties under the rubble, but rather the remnants of his nephews.
His Dreams:
`Ali dreamt to be a doctor to treat the people who were suffering under the occupation. He also dreamt to be a soldier to defend his family and country. Her aunt Shirin said: "`Ali was very active, his voice was echoing all the time in the house, and his voice was special, and everyone hears him they like his singing."

Israeli court rejects Daya family’s lawsuit
GAZA, (PIC)-- The Israeli central Court rejected a lawsuit filed by human rights organization from Gaza, on behalf of Daya family which lost 22 of its members during the war on Gaza.
The Palestinian Center for Human Rights said in a statement on Tuesday that the rejection decision represents "a continuation to the series of denial of justice for Palestinian victims."
It pointed out that the occupation court justified its decision on the grounds that the martyrs had died during a military operation and that the occupation forces are not responsible for that.
Hebrew newspapers also quoted the Judge as claiming: "The injury was unintended. In all wars errors occur that may kill people from both sides. During wars each party shall bear full responsibility for the damages on its elements or on civilians".
The occupation forces had bombarded on January 6, 2009, during its aggression on the Gaza Strip and known as "Operation Cast Lead", a house belonging to Fayez Mesbah Daya, located in Zeitoun neighborhood in Gaza City, resulting in destroying the house and killing 22 members of its inhabitants.
The human rights center noted that the court's issued such decision despite the confession made by occupation army in July 2009, that "faulty intelligence information led to shelling Daya family's house by Israeli warplanes", stressing that the Judge's logic cannot be accepted as the victims were civilians and protected under the fourth Geneva Convention.
